Jaffna police got an injunction order against the peaceful protest organized by NAFSO on land issues of the IDPs living in Jaffna peninsular. There are 32,000 reported IDPs living in Temporary shelters in Valikamam north area. Those IDPs expected support from NAFSO and southern people. NAFSO role was to facilitate the cooperation beteeen southern and northern communities. This was an effort to strengthen reconciliation process of the country too.
However, Jaffna police went to the court claiming "there are complains from 12 people in Jaffna requesting not to allow any protest in A9 road, Jaffna town to district secretaraiat from 9.00-4.00 pm on 15th July."
Without consulting the other party, here it is NAFSO Jaffna magistrate gave orders in the name of me and NAFSO as first respondent, Mavei Senadhiraja, (MP) deputy leader of TNA party and Ratna Gamage, Secretary general, all Lanka fisheries federation as second and third respondents.
It is in the court order to police to report back today to court after execution the order.
So at the civil society meeting held to discuss the challenge of such injunction orders to the peaceful actions of civil society organizations to express their views emerged the challenge such orders. Based on this today Me, Antony Jesudasn from NAFSO Negombo and Inbanayagam from Jaffna and also Brito Fernando R2L attended the court case today.
Also a lawyer representing MP, Mavei Senadirajah attended the case and challenged the majistrates order in the ground of violation of right to freedom of expression.
The 3 lawyers appeared at these court challenged the police and court demanded to consult the other party before take such orders from the court. Majistrate was in the view of police direction of public nuisance and issued such order with the fear of Aluthgana and Beruwala incidents had happened few weeks back. And also he stated that he had rejected several occassions of such police requests.
Although the majistrate court proceedings were over NAFSO is planning further legal action/s in the line of defamation grounds. We thank all three lawyers of Mr.Manivanan, V.L. Sivalingam and Mr. Kanaha Namanathan for their dedication and commitment with free service to our case as part of their social commitment.
